BY DOWNLOADING, INSTALLING, OR USING ANY ROBOT DUCK LLC APPLICATION OR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS DISCLAIMER IN ITS ENTIRETY. 1. Not a Certified Aviation Tool

The applications and services provided by Robot Duck LLC ("Robot Duck," "we," "us," or "our") are software products intended solely for educational, informational, and entertainment purposes. They are not certified, approved, or authorized by the Federal Aviation Administration (FAA), Transport Canada, the European Union Aviation Safety Agency (EASA), or any other aviation regulatory authority. Our applications do not constitute official aeronautical publications, certified navigation tools, certified weather briefing services, approved training courses, or any other FAA-approved product or service of any kind.

2. Not a Substitute for Official Preflight Briefings

Pursuant to 14 CFR § 91.103, each pilot in command is required to become familiar with all available information concerning a flight before beginning that flight. Our applications do not fulfill this regulatory obligation. Users must obtain official weather briefings from the FAA, 1800wxbrief.com, an FAA-approved weather service provider, or other authoritative sources before any flight operation. Nothing in our applications shall be construed as a complete or official preflight briefing.

3. Pilot in Command Responsibility

Pursuant to 14 CFR § 91.3, the pilot in command of an aircraft is directly responsible for, and is the final authority as to, the operation of that aircraft. Our applications are decision-support tools only. All go/no-go decisions, flight planning decisions, and operational decisions remain solely the responsibility of the pilot in command. Robot Duck LLC accepts no responsibility whatsoever for any decision made in reliance upon information provided by our applications.

4. GoNoGo Application — Specific Disclaimers

4a. Decision Terminology. The terms "FAVORABLE," "MARGINAL," and "NO-GO" used in the GoNoGo application are internal risk-assessment labels generated by automated software algorithms. They do not constitute official aviation designations, regulatory determinations, clearances, or approvals of any kind. A "FAVORABLE" result does not mean a flight is safe, legal, or advisable. Users must independently evaluate all conditions before any flight.

4b. TFR and Airspace Data Limitations. Beginning with GoNoGo version 2.0, the application attempts to retrieve Temporary Flight Restriction (TFR) data from the FAA data cache hosted at aviationweather.gov. When available, active TFRs near the route are flagged as NO-GO conditions. HOWEVER, THIS TFR CHECK IS NOT COMPREHENSIVE AND MUST NOT BE RELIED UPON AS YOUR SOLE OR PRIMARY TFR SOURCE. TFR data may be unavailable, delayed, incomplete, or not reflect real-time changes. The GoNoGo application DOES NOT retrieve or display Notices to Air Missions (NOTAMs), Special Use Airspace (SUA), or other airspace restrictions and advisories. Users must independently consult official FAA sources (tfr.faa.gov, 1800wxbrief.com, or a certified AFSS briefing) for all NOTAM and TFR information before any flight. A "FAVORABLE" result from GoNoGo, even with no TFRs detected, does not constitute airspace clearance or legal authorization to fly. Launching an aircraft into a TFR is a serious federal violation that may result in civil penalties, certificate action, or criminal prosecution. Robot Duck LLC accepts no liability whatsoever for any airspace violation arising from reliance on our applications.

4c. Geographic Limitation. Extended forecast data in the GoNoGo application is sourced from the National Weather Service (NWS) and is limited to United States territory. Routes involving airports outside the United States, including Canadian airports, may receive incomplete or unavailable extended forecast data. Users operating in non-US airspace must obtain weather information from appropriate local authoritative sources.

4d. Push Notification Unreliability. The GoNoGo application's route-watching feature relies on iOS background app refresh and push notification delivery, which are subject to operating system scheduling, device settings, network availability, and other factors outside Robot Duck LLC's control. Notifications may be delayed, suppressed, or not delivered at all. Robot Duck LLC makes no guarantee that notifications will be delivered in a timely manner or at all. Users must not rely on push notifications as a primary or sole source of weather change information. Always obtain a current official briefing before flight regardless of notification status.

4e. Weather Data Currency. Weather data displayed in the GoNoGo application may be delayed, incomplete, or stale due to third-party API availability, network conditions, or caching. Robot Duck LLC makes no representation that data displayed reflects current conditions at the time of viewing.

5. PTT Application — Specific Disclaimers

5a. Educational Purpose Only. The PTT (Push to Talk) application is an educational tool designed to help users practice aviation radio communication phraseology in a simulated environment. It is not an FAA-approved ground school course, not an approved training device (ATD), not an aviation training device (BATD/AATD), and does not satisfy any FAA regulatory training or currency requirement. Completion of exercises in the PTT application does not qualify a user for solo flight, any certificate or rating, or any regulatory requirement whatsoever.

5b. Speech Recognition Accuracy. The PTT application uses automated speech recognition technology to evaluate user radio communications. Speech recognition is inherently imperfect and may incorrectly evaluate, accept, or reject phraseology. A passing score or positive evaluation from the PTT application does not mean that a user's phraseology is correct, safe, or appropriate for use in real-world aviation radio communications. Robot Duck LLC makes no representation that any phraseology evaluated as correct by the application would be understood, accepted, or appropriate in actual air traffic control (ATC) communications.

5c. ATC Communication Liability. Real-world aviation radio communications with air traffic control are governed by 14 CFR Part 91 and applicable ATC procedures. The PTT application simulates a limited subset of communication scenarios and does not replicate the full complexity of live ATC environments. Any radio communication made to live ATC is solely the responsibility of the pilot in command. Robot Duck LLC accepts no liability for any miscommunication, pilot deviation, airspace incursion, enforcement action, accident, incident, or other consequence arising from the use or misuse of phraseology practiced in or derived from the PTT application.

5d. Requirement for CFI Instruction. Aviation radio communication is a skill that must be developed under the supervision of a certificated flight instructor (CFI). The PTT application is a supplemental practice tool only and is not a substitute for instruction, endorsement, or sign-off from a qualified CFI. Users should not attempt real-world radio communications solely on the basis of practice within the PTT application without appropriate CFI guidance.

5e. Content Accuracy. While Robot Duck LLC endeavors to ensure that phraseology scenarios and content within the PTT application reflect standard FAA and ATC procedures, aviation procedures, phraseology standards, and regulations are subject to change. Robot Duck LLC makes no warranty that all content is current, complete, or accurate at the time of use. Users should consult the current FAA Aeronautical Information Manual (AIM), applicable FAA Advisory Circulars, and their CFI for authoritative guidance.

6. Accuracy and Reliability of Data

Our applications retrieve data from third-party sources including, but not limited to, the Aviation Weather Center (aviationweather.gov) and the National Weather Service (weather.gov). Robot Duck LLC makes no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, timeliness, reliability, or availability of any data displayed in our applications. Weather data is inherently uncertain and subject to rapid change. Data may be delayed, incomplete, unavailable, or erroneous. Users must independently verify all information before relying upon it.

7. Student Pilots and Supervised Operations

Student pilots operating under 14 CFR Part 61 are subject to specific limitations and endorsement requirements. Our applications do not provide any endorsement, authorization, or approval for student pilot operations. Student pilots must operate only under the direct supervision and with the current endorsement of a certificated flight instructor as required by applicable regulations. Robot Duck LLC accepts no liability for any student pilot operation conducted in reliance upon our applications.

8. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROBOT DUCK LLC PROVIDES ALL APPLICATIONS AND SERVICES "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. ROBOT DUCK LLC DOES NOT WARRANT THAT THE APPLICATIONS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY ROBOT DUCK LLC OR ITS REPRESENTATIVES SHALL CREATE ANY WARRANTY.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROBOT DUCK LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

(a) personal injury, bodily injury, or death;

(b) damage to or destruction of aircraft, property, or equipment;

(c) loss of revenue, profits, data, use, goodwill, or other intangible losses;

(d) damages arising from reliance on any information, decision label, or phraseology evaluation provided by our applications;

(e) damages arising from any interruption, suspension, delay, or termination of our applications or notifications;

(f) damages arising from unauthorized access to or alteration of your transmissions or data;

(g) damages arising from any airspace violation, TFR incursion, or regulatory enforcement action;

(h) damages arising from any ATC miscommunication or pilot deviation;

(i) damages arising from the failure of push notifications to be delivered or delivered in a timely manner;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ROBOT DUCK LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, ROBOT DUCK LLC'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN ALL CASES, ROBOT DUCK LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OUR APPLICATIONS SHALL NOT EXCEED THE AMOUNT YOU PAID TO ROBOT DUCK LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN DOLLARS (USD $10.00), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Robot Duck LLC and its members, managers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our applications; (b) your violation of this Disclaimer or any applicable law or regulation, including any FAA regulation; (c) your violation of any third-party right, including any intellectual property right or privacy right; (d) any claim that your use of our applications caused damage to a third party; (e) any flight operation or aviation decision made in connection with use of our applications; (f) any airspace violation, TFR incursion, or regulatory enforcement action; or (g) any miscommunication with air traffic control arising from phraseology practiced in the PTT application.

11. Assumption of Risk

Aviation involves inherent risks, including the risk of serious injury or death. By using our applications in connection with any flight operation, flight planning activity, or aviation training activity, you expressly assume all risks associated with such use, including risks arising from inaccurate, incomplete, delayed, or unavailable data, inaccurate speech recognition evaluations, missed or delayed notifications, and the absence of NOTAM or TFR data. You acknowledge that you are a trained, certificated pilot or are under the direct supervision of one, and that you possess the knowledge and judgment necessary to evaluate and independently verify all information before acting upon it.

12. Third-Party Data and Services

Our applications rely on data and services provided by third parties, including aviationweather.gov, weather.gov, and iOS system services. Robot Duck LLC has no control over, and assumes no responsibility for, the content, accuracy, privacy practices, or availability of any third-party data sources or services. Any reliance you place on third-party data accessed through our applications is strictly at your own risk.

13. No Emergency Services

Our applications are not designed or intended for use in emergency situations. Do not rely on our applications to obtain emergency assistance or to manage any in-flight emergency. In any emergency, contact the appropriate emergency services, declare an emergency with air traffic control on 121.5 MHz, or use established emergency procedures in accordance with your training and applicable regulations.

14. Force Majeure

Robot Duck LLC shall not be liable for any failure or delay in the availability or performance of our applications resulting from causes beyond our reasonable control, including but not limited to acts of God, network failures, third-party API outages, government actions, natural disasters, or iOS operating system changes.

15. Governing Law and Dispute Resolution

This Disclaimer shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Disclaimer or the use of our applications shall be resolved exclusively in the state or federal courts located in Minnesota, and you hereby consent to personal jurisdiction and venue in such courts.

16. Severability

If any provision of this Disclaimer is held to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Changes to This Disclaimer

Robot Duck LLC reserves the right to modify this Disclaimer at any time. Changes will be effective upon posting to this page. Your continued use of our applications following the posting of changes constitutes your acceptance of those changes.
